It is amazing what changes have been made to the legal system in British Columbia, and no one is concerned as to the MAGNITUDE of the situation! Our basic rights granted by the Magna Carta, have been SUBVERTED by the present Provincial legislation. Do you realize that your car has been given (in practice) the status of a "person" in law, and that is the BASIS of the photo radar and red light intersection camera (automated enforcement) tickets. These changes are also taking place in Britain and America. This affects YOU, and the rest of the British Commonwealth and the United States , if left unchecked.
It's Creeping Up On Us !! Years ago, the public accepted the idea of 24 hour driver's license suspensions. This practice avoided the increasing costs, to the police and justice system, of arresting and prosecuting drivers who had obviously overindulged in alcoholic beverages. The justification: it saved time and money. The thought did not cross our minds that there is a consequence for acceptance of this breach of principle of law. We accepted "summary convictions" without going through the court system. We accepted pleading "guilty" on the spot, without considering the future consequences. We are now paying the price! The continuum went from 24 hour suspensions, to photo radar, then to mandatory 1 year driver's license suspensions, now to red light cameras (unmanned public surveillance) -- the "Big Brother" of George Orwell's fame. But wait a minute. We have forgotten a step along the way. The provincial government amalgamated the Superintendent of Motor Vehicles Office with the Insurance Corporation of British Columbia. Do you know what that means? Present legislation amalgamates two entities of our law -- that of CRIMINAL law with that of CIVIL law. Do you get the SIGNIFICANCE !!! ? Under criminal law you are "innocent until proven guilty" . The burden of proof is upon the Crown. Under civil law (or the law of torts), the burden is shared between the two opposing parties. In other words, we have to choose between the right of presumed innocence and the burdens of civil law. Guess which has won out. You guessed it. We have lost the right of "presumed innocence" in British Columbia. There is more. If you do not pay the moving violation tickets on time or not at all, I.C.B.C. (Insurance Corporation of British Columbia) turns the responsibility of collection to a collection agency . You get a BAD CREDIT rating !!! How do you like that for good government? Is it FOR the people? There is more yet. If you read the photo radar (automated enforcement) ticket carefully, the Crown is accusing your car of committing a moving traffic violation. That's right! It is NOT your drivers license that is mentioned, but your license plate is the reference on the ticket. (Don't laugh too hard it gets better -- or worse?) Then the ticket states that the Crown is prosecuting the owner of that car for the violation the car committed. An Ancient Principle of Law Here is a principle of law that goes beyond the thought of the average person these days. It was a founding principle of our common law and our ancestors understood it perfectly. It states: "Fathers shall not be put to death for their children, nor shall the children be put to death for their fathers; a person shall be put to death for his own sin." (Written by Moses in the Book of Deuteronomy.) A man is responsible for his own sins and for himself breaking the law. He is not responsible for another man's sin. With photo radar and red light camera enforcement, we hold an individual responsible for an act that we cannot prove he committed? As a society, we are holding a man responsible for an act that another individual may have committed. That is injustice!! The Case of the Smoking Gun Have you ever heard of a police officer arresting a smoking gun for attempted murder? How about arresting a speeding bullet for murder? Ridiculous? Well, that is the kind of thing we are doing with photo radar and red light cameras. We are "arresting" the car for committing a crime. "Hearsay Evidence" What about the fact that it is "hearsay" that the owner of the car was driving the car at that time of the alleged offence? The police are obliged to identify the driver of the car at the time of any offence, before he can be charged. What do the police think driver's licenses are issued for in the first place? How could any judge allow a photo radar (automated enforcement) ticket into his courtroom? Why aren’t the police officer and the crown counsel, both fined for contempt of court, for bringing this kind of stupidity before a judge? To me, the photo radar practice is contemptuous to the public and to the justice system. The Magna Carta and The Constitution Act 1982 The Magna Carta of 1215, which forms a part of our " common law " makes it clear that the state has to provide evidence before it can bring a writ against an individual. This document established the principle of "presumption of innocence". The Charter of Rights, Section 11(d) states that we are to be presumed innocent in criminal law. The Constitution Act 1867 clarifies that there are two types of law: criminal and civil law for Canada. Let's keep them separate! Let's retain the right of "presumed innocence". Let the State prove a man guilty! The Confirmatio Cartarum of 1297, makes it clear to: "our justices, sheriffs, mayors, and other ministers, which under us have the laws of our land to guide, shall allow the said charters pleaded before them in judgement in all their points... ." The crown makes it clear to our courts they must allow the Magna Carta to be exercised and argued before the court in all matters referred to in the charters. In fact, the judges are responsible, under penalty of the Confirmatio Cartarum, to enforce the rights in the Magna Carta in all their judgements and in all the courts of the land. The matters in the Magna Carta are to be enforced (in principle) by the justices, the politicians, the police and all officials under the crown. This is the law. I suppose no one cares if they are excommunicated for breaking the Confirmatio Cartarum. But, this places God in the picture, as does the Canadian constitution. Their is an appeal to the Highest Court in Heaven -- that of the Almighty Judge and God of our fathers. Do you fear God? Do you judges and lawyers (officers of the court) think you are above the law? Are you beyond of the reach of the God of Israel? It is He you ought to fear , not men. Look up the book: Lex Rex, or The Law of the Prince (or King) , by Samuel Rutherford (1600-1661.) Rutherford showed in this book that only God has absolute authority, and even the King must obey the law. How about this: "And what great nation is there that has such statutes and righteous judgements as are in all this law which I set before you this day?" (Deuteronomy 4:8) We should not have to worry about automated enforcement tickets turning up in the mail. Get rid of photo radar and red light cameras. Bring back justice and give us peace of mind. Bring out righteousness in our land.
The Big Issues Marxist-indoctrinated Provincial government has substituted emotional issues for rights of the person . We are told red light cameras protect our children. That is a lie. In one incident a stolen vehicle was involved in a motor vehicle accident, killing two boys. The driver of the stolen vehicle got away and was never caught. The car licence plate could not reveal the identity of the thief, as the car was stolen. The red light cameras could not protect those two boys. The public should stop confusing insurance obligations (civil law), with criminal law. They are separate parts of the justice system. The principle of presumed innocence provided in the Magna Carta through burden of proof being with the Crown, is being attacked and removed from our criminal law. The R.C.M.P. officer appearing on B.C.T.V. stating presumed innocence is only in our courts should take Law 101, and re-learn the basis of our constituted law. Our judges should do the same!
The conclusion of the matter simply is -- the principle of presumed innocence is entrenched in our Common Law, and the Law of the Land, in Canada, the British Commonwealth, and in the United States of America. (Note: the newly elected provincial government, under Premier Gordon Campbell, has repealed photo radar cameras legislation and the issuance of photo radar tickets, as of August, 2001. The red light intersection camera legislation is still law, and tickets are being issued, by the Insurance Corporation of British Columbia. I.C.B.C. is still involved in issuing speeding tickets, and B.C. driver's licences. Premier Campbell has only done half the job. It is time to repeal red light intersection camera legislation.)
